Description

The Claims Counsel reflects the mission, vision, and values of NMHC, adheres to the organization's Code of Ethics and Corporate Compliance Program, and complies with all relevant policies, procedures, guidelines and all other regulatory and accreditation standards.

Responsibilities:

  • Create and implement effective and cost efficient coordination and management of litigation and claims, including coordination of discovery activities with outside counsel and NMH risk managers; maintain claim files; review disbursements for approval; and develop and maintain effective database for claims tracking.
  • Direct litigation and claims strategy, including settlement or trial strategies; negotiation of certain settlements and identification of risk trends and recurring issues requiring solution or staff/physician education.
  • Report to Reserving Committee regarding claim evaluations and manage Loss Advice Forms and other insurance notice of loss documentation.
  • Coordination and management of communications with excess carriers and reinsurers, including preparation and submission of loss advice information and reserving lawsuits, liens, and claims.
  • Manage and oversee trial and deposition matters, including coordination and preparation of witnesses and acting as NMH representative at selected legal proceedings.
  • Perform other duties and functions as assigned by the Director of Litigation and Claims in support of the risk, quality, financial and management strategies of the organization.
  • Demonstrate excellent interpersonal and negotiating skills, as well as communicate effectively with physicians, nurses, and other health care professionals.
  • Represent insured at, and prepare them for deposition.
  • Provide legal counsel to various NMHC departments on litigation related issues.
  • Review contracts/documents for issues related to litigation/insurance.
  • Respond to subpoenas issued in non-NMH matters.
  • Conduct legal research.

Qualifications

Required:

  • Bachelor's degree in relevant field.
  • Juris Doctor.
  • 5 years medical malpractice claims management experience.
  • Excellent oral and written communication skills.

Preferred:

  • Health care experience.
  • Working knowledge of insurance coverage
